Due to the Covid-19 emergency, you cannot appear in person at the courthouse on your court date.

If you have been served with an Answer Hearing:

If you do not dispute the claim you need to take no action and a default judgment will be entered against you for the amounts stated in the Petition. You should contact us and make payment arrangements.

If you dispute the claim you should do one of the following:

  • Contact your attorney who may appear for you.
  • If you do not have an attorney you may:
    • A. File a written Answer with the Atchison County District Court prior to the court date. The Answer must state the following:
      • i. what the dispute is;
      • ii. any affirmative defenses you have to the claim;
      • iii. any counterclaim you may have; and
      • iv. your current address, phone number, fax number, and e-mail address.
      • v. Include the case number on your Answer.

      Send a copy of your Answer to the attorney for the plaintiff, or the plaintiff if the plaintiff has no attorney, and file a copy with the District Court located at 423 N 5th Street Atchison, KS 66002.

      You will be notified by the court of the trial date for your case.

      B. If you do not file a written Answer prior to the court date you may appear by Zoom video conferencing at the docket date and time.

      If you do not have internet or you do not have a smartphone, you are required to call in to the hearing by calling 1-312-626-6799 and enter the meeting ID (see above) and password 955079.

      You are required to file a written Answer no later than 14 days after the above appearance date if you deny the claim.

If you have been served with a Hearing in Aid of Execution or need to appear for an Order Back:

You MUST appear in person at our office anytime during the week of your court date.

Failure to appear and provide the requested information may result in a Citation in Contempt being requested from the court.
